Passport-specific Visa Waiver Program/ESTA or B visa; separate work authorisation
Admission and permission to work are separate. The Visa Waiver Program permits eligible passport holders to seek admission for tourism or limited business for no more than 90 days, and B-1 permits specified temporary business activities. Neither is a general digital-nomad status. Remote duties must be assessed against the exact admission category, facts and current agency guidance; obtain work authorisation or qualified advice when needed.
- Check Visa Waiver Program eligibility for the exact passport and obtain ESTA when required
- Match every planned activity to the permitted scope of the admission category
- Do not treat tourism or a business visit as general permission for productive remote work
- Obtain an appropriate work-authorised status when the activity falls outside visitor rules
- Track federal, state, local and home-country tax residence and income-source exposure
